EB3 Program - Unskilled Worker Category
The EB3 Program supports industries with long-term labour shortages with long-term solutions. Employers who meet the program requirements can support Unskilled Workers (occupations requiring less than two years of training or experience) to enter the United States as Green Card holdersfor full-time and permanent employment. Applicants must meet the minimum qualification requirements and can include his/her spouse and unmarried children below the age of 21 in the application.
Requirements
- Applicant must be physically fit (in good health conditions to perform the work).
- No educational requirements.
- No Language Test, only minimal English is required.
- Commitment to work with the employer for a minimum of one and a half years.
Government Fees
- USD $700 Form I-140 Filing Fee
- Optional USD $1,440 Premium Processing Upgrade
- USD $345 National Visa Center Fee per person (for Visa)
- USD $220 USCIS Immigrant Fee per person (for Green Card)
H-2B
The H-2B Non-Immigrant Program supports industry with short-term labour shortages with short-term solutions. Employers who meet the program requirements (including non-agriculture labour and services industries) can support Workers to enter the United States on a one (1) Year Visa for full-time employment. The employment must be of a temporary nature for a limited period of time such as a one-time occurrence, seasonal need, peakload need or intermittent need.
Requirements
To qualify for H-2B non-immigrant classification, the petitioner must establish that:
- There are not enough U.S. workers who are able, willing, qualified, and available to do the temporary work.
- Employing H-2B workers will not adversely affect the wages and working conditions of similarly employed U.S. workers.
- Its need for the prospective worker's services or labour is temporary, regardless of whether the underlying job can be described as temporary.
